§ 1 Scope of application
For the business relationship between Leopold Halling GmbH (hereinafter referred to as "LEOPOLD HALLING") and the purchaser, the following general terms and conditions shall apply in their version valid at the time of the order. LEOPOLD HALLING does not accept any deviating conditions of the customer, unless LEOPOLD HALLING had expressly agreed to their validity in writing. All rights reserved.
§ 2 Contract conclusion
Your order constitutes an offer to us to conclude a purchase agreement. When you place an order at LEOPOLD HALLING, we will send you an e-mail confirming the receipt of your order with us and listing its details (order confirmation). This order confirmation does not represent acceptance of your offer, but is only intended to inform you that your order has been received by us. A purchase contract is not concluded until we send the ordered product to you. There is no purchase contract for products from the same order that are not listed in the shipping confirmation. LEOPOLD HALLING does not offer any products for purchase by minors. Also our products for children can only be bought by adults. Please note that we sell all products only in household quantities. This applies both to the number of products ordered as part of an order and to the task of several orders of the same product, in which the individual orders comprise a household quantity. After the agreement on the availability, we reserve the products for a maximum of 2 weeks reserved for you. If no payment or collection is made, we can assign the models to other customers and cancel your order.
§ 3 return costs agreement, right of revocation up to 14 days, exclusion of the revocation right
Agreement on the cost:
If you exercise your right of revocation, you have to bear the regular costs of the return if the delivered goods corresponds to the ordered. Otherwise, the return is free for you.
Withdrawal:
You can revoke your declaration of the contract within 14 days without giving reasons in text form (eg letter, fax, e-mail) or - if the matter is left to you before the deadline - by returning the goods. The period begins after receipt of the goods or service.
Consequences of Withdrawal:
In the case of an effective revocation, the services received at both ends must be returned and any benefits (eg interest) drawn. If you can not or do not return or receive the received performance as well as usages (e.g., advantages of use) in a deteriorated condition, you must provide us with this information. This may mean that you must nevertheless fulfill the contractual payment obligations for the period up to the cancellation. Special instructions:
In the case of a service, your right of revocation expires prematurely if the contract has been completely fulfilled by you and LEOPOLD HALLING upon your express request before you have exercised your right of revocation.
Exclusion of revocation:
The right of revocation does not exist
• for the delivery of goods which are manufactured according to customer specifications or which are clearly tailored to the personal requirements or which are not suitable for a return due to their nature or which can quickly spoil or whose expiry date would be exceeded,
• for the supply of books, audio or video recordings or software, provided that the delivered data media have been unsealed by the consumer;
• for the delivery of newspapers, magazines and magazines
§ 4 Our voluntary redemption guarantee (up to 30 days)
LEOPOLD HALLING offers you the following voluntary redemption guarantee: All products of LEOPOLD HALLING can be returned to us within 30 days from receipt of the goods, provided the goods are complete and in unused and undamaged condition. For sealed and / or sealed data carriers (for example, books, CDs, audio cassettes, VHS videos, DVDs, PC and video games as well as software), this means that we only take back the product in the unsealed shrink film or with an undamaged seal. In the case of a return, taking into account the conditions mentioned in § 4 above, we will refund the purchase price you have already paid, but not the shipping costs. They carry the risk of transportation. This redemption guarantee does not limit your statutory rights and therefore not your right of revocation under § 3 of these General Terms and Conditions.
§ 5 Delivery
LEOPOLD HALLING supplies ordered products ex stock Vienna, if you are in stock, in the order of the order. Delivery takes place after receipt of payment, if possible, within 24 hours or the next working day. Unless otherwise agreed, the delivery shall be made after receipt of the payment to the delivery address indicated by the purchaser. On the website you will find information on the availability of products sold directly by LEOPOLD HALLING (see the "Traffic light" on the respective product details page). We would like to point out that all information on the availability, dispatch or delivery of a product is merely indicative and approximate. They do not constitute binding or guaranteed shipping or delivery dates, unless this is expressly designated as a binding date for the shipping options of the respective product. If LEOPOLD HALLING finds that your ordered products are not available during the processing of your order, you will be informed separately by e-mail. You have the option to leave an order as a pre-order or to withdraw from the purchase order. In the event that LEOPOLD HALLING is unable to fulfill its contractual obligations, LEOPOLD HALLING is entitled to withdraw from the contract. In this case, the purchaser is immediately informed that the ordered product is not available. The legal rights of the customer remain unaffected. If only one part of several ordered models is available immediately, the deliverable goods will be shipped if the goods value reaches 1/3 of the total order value. Reservations for delivery or self-collection longer than for 4 weeks are possible only against payment of approx. 1/3 of the order value. We gladly accept pre-orders / reservations for small batches and non-stocking products in order to correctly estimate the required number of pieces during production. SUCH PRE-ORDERS ARE NOT BINDING TO THE CLIENTS FOR LEOPOLD HALLING COMPANY. By pre-ordering non-stock or not yet produced models, you can secure your delivery at the earliest possible time and at the current prices. Pre-ordered models are produced according to Leopold Halling and only with a sufficient customer interest. If pre-ordered models are available, the customer will be informed of this by means of a preliminary invoice. And has the possibility to decide finally by paying the invoice amount for the purchase or without further legal consequences thereof. Order option: via the web shop, with our order form by post or by fax, further by email, by phone or personally in our business location. Insofar as a delivery to the customer is not possible, because the customer is not found under the delivery address specified by him, the buyer bears the costs for the unsuccessful delivery. The shipping costs are - until further notice - per delivery 6 EUR in Austria and 16 EUR in Europe. When shipping to non-European customers, we will charge for the possible extra costs.
§ 6 Due date and payment, default
LEOPOLD HALLING supplies only against prepayment or against the cost of the cash on delivery charge by COD. LEOPOLD HALLING reserves the right to offer certain payment methods in individual cases. The purchaser may pay the purchase price by invoice (under the conditions specified in § 7), credit card or direct debit. LEOPOLD HALLING will send an invoice before a partial delivery or complete delivery. The amount has to be paid before delivery to LEOPOLD HALLING (advance payment). Cash payment is required at the business location, bank payment as well as payment by VISA, EUROCARD or DINERS CLUB are possible. In the case of online purchase, the payments are made by transferring them to the company account of LEOPOLD HALLING. Bank charges shall be borne by the customer. We recommend the so-called "EURO Überweisung", which is free of charge in the EU, with IBAN and BIC. In the event that the goods are sent or delivered against an open invoice with a payment destination due to special agreements, LEOPOLD HALLING shall be entitled to pay default interest of 5% above the amount announced by the European Central Bank Base rate pa to promote. § 7 Special features when buying on account
Payment on account is possible only by special agreement for companies, but not for private consumers. § 8 Offsetting, Retention
The customer is only entitled to a set-off right if his counterclaims have been legally established or undisputed by LEOPOLD HALLING. In addition, he is entitled to exercise a right of retention only to the extent that his counterclaim is based on the same contractual relationship.
§ 9 Price
For customers within the European Union and Austria: All prices include the respective applicable VAT. The prices are ex stock LEOPOLD HALLING in Vienna 1100, unpacked, uninsured. If the UID number is verified, the delivery is considered "Innergemeinschaftliche Lieferung" (intra-community delivery) for customers from the European Union and no VAT is charged. This only applies if the transport has been confirmed to an EU country by post, courier service or forwarding agency. For customers outside the European Union: Prices are net of VAT. This applies only if the transport has been confirmed abroad by post, courier or forwarding agency. Pre-order prices can only be claimed if they are actually booked in advance. Without pre-ordering, the current list prices are valid; The delivery of non-pre-ordered models takes place in the order of the order, as far as available. Pre-buyers have priority.
§ 10 Reservation of title
The goods delivered remain the property of LEOPOLD HALLING until complete payment.
§ 11 Liability for Defects
If the repair of defects is agreed by way of a replacement delivery, the buyer is obligated to return the defective goods delivered to LEOPOLD HALLING within 30 days. LEOPOLD HALLING shall be liable without limitation if the cause of the damage is based on intent or gross negligence. Furthermore, LEOPOLD HALLING is liable for the slightly negligent breach of essential obligations whose violation jeopardizes the attainment of the contractual purpose or for the violation of obligations which fulfill the proper implementation of the contract and which you regularly trust to comply with. In this case, however, LEOPOLD HALLING is only liable for the foreseeable, contract-type damage. LEOPOLD HALLING shall not be liable for the slightly negligent violation of obligations other than those specified in the preceding sentences. The above limitations of liability do not apply in case of injury to life, body and health, for a defect after assumption of a guarantee for the quality of the product and in the case of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected. Insofar as the liability of LEOPOLD HALLING is excluded or restricted, this also applies to the personal liability of employees, representatives and vicarious agents.
§ 12 Warranty and Guarantee
LEOPOLD HALLING guarantees the quality of its own products up to one year after the date of purchase by replacing the damaged goods, repair or purchase price reimbursement where possible. LEOPOLD HALLING is to be informed of the warranty case before the goods are returned. The costs for a return are to be borne by the customer, dispatch charges after handling a justified warranty claim takes over Leopold Halling. Excluded from warranty are transport damage.
